Headset Repair Centre: Terms of Business

The Headset Repair Centre ( Headset Sales Ltd Trading As ) Standard Terms & Conditions of Service & Repair
Definitions

In this agreement the terms have the following meanings:

  1. "Customer" means the user of the Repair Service from Headset Sales Ltd. Trading As The Headset Repair Centre (Referred to herein as "HRC")
  2. "Supplier" means Headset Sales Ltd. Trading As The Headset Repair Centre (Referred to herein as "HRC")
  3. "Agreement" means the contract between Headset Sales Ltd. Trading As The Headset Repair Centre (Referred to herein as "HRC")and the Customer to which these conditions will apply.
  4. "Services" is the Repair Service that Headset Sales Ltd. Trading As The Headset Repair Centre provides (Referred to herein as "HRC")

Scope and Law

This Agreement shall apply to all Services purchased by a Customer from HRC. By agreeing to these Terms your statutory rights are not affected.
Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by a Director of HRC.

Except in respect of death or personal injury caused by HRCs negligence, or as expressly provided in these Conditions, HRC shall not be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of HRC, its servants or agents or otherwise) which arise out of or in connection with the provision of the Services, and the entire liability of HRC under or in connection with the Contract shall not exceed the amount of HRCs charges for the provision of the Services, except as expressly provided in these Conditions.

Proper law of Contract. This Contract is subject to the law of England and Wales.
Force Majeure. HRC shall not be liable to the Customer or be deemed to be in breach of the Contract by reason of any delay in performing or any failure to perform any of HRCs obligations if the delay or failure was due to any cause beyond HRCs reasonable control.
Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond HRCs control: -

Act of God. explosion, flood, tempest, fire or accident.
War or threat of war, sabotage, insurrection, or civil disobedience.
Act, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary or local authority.
Import or export regulations or embargoes.
Strikes lockouts or other industrial actions or trade disputes whether involving employees of HRC or of a third party.
Difficulties in obtaining raw materials, labour, fuel, parts or machinery.
Power failure or breakdown in machinery.
Failure or inadequacy of postal or delivery services or the like.

Alterations to Standard Terms & Conditions of Service & Repair

HRC reserves the right to alter these Terms & Conditions of Service & Repair at any time and will replace the Terms & Conditions of Service & Repair on our web site when we do so.

Initiating the Repair Process

Customers will complete the Online Repair Form at www.HeadsetRepair.co.uk . By completing the form the Customer is agreeing to these Terms & Conditions of Service & Repair. No work will be carried out by HRC until a Customer completes the aforementioned Online Repair Form.

Cancellation of an Order

If for any reason you wish to cancel your Repair order please e-mail repairs@headsetsales.co.uk or telephone 0151 653 8082 detailing your postcode and the date of your Repair order. If we have not already commenced Repair of your items we will cancel the order and seek your instructions for the return of the items un-repaired.

Payment

All transactions are in £ GBP. Payment for Repairs and any shipping costs must be received IN FULL prior to despatch back to customer of any Repaired items. HRC do not offer credit terms to customers.

Shipment and Delivery

The Customer will choose their preferred return shipping option for their Repair order during completion of the Online Repair Form at www.HeadsetRepair.co.uk

Customers also choose their own insurance levels on return shipping of Repaired items. HRC will not be held responsible for any deliveries that go missing or are damaged in transit beyond the maximum amount insured that the customer has chosen; or actual value of goods if less.

No Repaired items will be shipped until payment for repairs and any shipping cost has been received IN FULL. HRC do not offer credit terms to customers.

Damaged Items, Incorrect or faulty Items.

PLEASE check your Repair order at time of receipt and advise us of any problems or damage immediately on 0151 653 8082, ideally whilst the delivery person(s) are still on site.

Customers should also check, within 72 hours of delivery, that all Repaired items that have been repaired by HRC are working fully to their satisfaction.
Any problems must be notified within 72 hours of delivery. In all instances of possible damage in transit please KEEP ALL PACKAGING for inspection by us or our insurers. Please also keep any courier documentation.

WARRANTY

All Repairs come with a 6 month warranty against defects in materials supplied by HRC as part of the Repair process or defects in workmanship applied by HRC during the Repair process.

For an additional payment you may, at time of placing your Repair Order online, opt to extend the warranty period to 12 months.
The Warranty does not cover physical damage to the Repaired items once back in your possession as we have no control over how much physical force is applied to an item outside of our control.

Typical situations not covered under Warranty include, but are not limited to:-
Physically broken headbands, physically broken Mic Booms or arms. Cut, chewed and badly twisted wires. Plugs and connectors with physical damage. Any accessories such as foam ear cushions and voice tubes which are classed as consumables.

Tax and VAT Charges

HRC is UK VAT Registered. Our UK VAT registration number is: GB 884 2577 82

VAT is charged on all orders at the current rate.

Customs and tax charges may be applicable for shipping to countries out with the European Union (EU). HRC endeavour to put the correct Customs Clarifications / Commodity Codes on parcels. However, we cannot be held responsible for import duties and charges incurred by the Customer
EU Member States (as at May 2007) include: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxemburg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
